JUDGMENT OF THE EUROPEAN COURT IN A CASE M.B. and Others V. SLOVAKIA

The European Court of Human Rights by its judgment in the case of M.B. and Others v. Slovakia of 1 April 2021 ruled that Slovakia had violated the right of three Roma boys to an effective investigation into the police violence they objected.

On 20 August 2020, the Regional Court in Bratislava upheld the judgment of the first instance court that in March 2019 dismissed our actio popularis lawsuit filed on the basis of the Slovak Anti-Discrimination Act. It confirmed that the sued state authorities have no obligation to take measures on the elimination of segregation of Roma children in a local primary school in a village Terňa. We are planning to submit an extraordinary appeal to the Supreme Court.

The European Court of Human Rights in Strasbourg by its judgment in the case R.R. and R.D. v. Slovakia on 1 September 2020 ruled that Slovakia violated the rights of two injured Roma in relation to police violence during a police raid in the Roma community in Moldava nad Bodvou in 2013 in eastern Slovakia.

Decision of the Regional Court in Bratislava in a case concerning alleged segregation of Roma children at a primary school in Stará Ľubovňa

On 29 April 2020, the Regional Court in Bratislava upheld the judgment of the first instance court that in October 2016 dismissed our actio popularis lawsuit filed on the basis of the Slovak Anti-Discrimination Act. The lawsuit addressed segregation of Roma children at a primary school in a town district Stará Ľubovňa - Podsadek. We are planning to submit an extraordinary appeal to the Supreme Court.

District court judgment concerning alleged segregation of Roma children at a primary school in Muránska Dlhá Lúka

District Court Bratislava III on 6 February 2020 dismissed actio popularis lawsuit of our non-governmental organization against the Slovak Republic, represented by the Ministry of Education, addressing segregation of Roma children at a primary school in a village Muránska Dlhá Lúka and failures of the state authorities to take effective measures to eliminate it. The judgment is in Slovak only and is not final.

Decision of the Constitutional Court of Slovak Republic confirming backlogs in anti-discrimination dispute

In its decision of 21 January 2020, the Constitutional Court of the Slovak Republic found a violation of the right of our NGO as the plaintiff in an anti-discrimination dispute concerning the alleged discrimination of Roma children in education, to hear a case within a reasonable time.

Regional Court in Košice as appeal court by its judgement from 20 November 2019 upheld the first instance court decision and awarded financial compensation for unlawful sterilization. The court decsion is available in Slovak only.

On 28 January 2020, the European Court of Human Rights in Strasbourg announced its judgment in a case A.P. against Slovakia. The Court found violation of the applicant's right to protection from cruel and inhuman treatment under Art. 3 of the European Convention.

By its decision of 7 March 2018, the Constitutional Court of the Slovak Republic confirmed that the right to hear a case within a reasonable time has been violated in actio popularis proceededing concerning discrimination that was initiated by our NGO.
